Fair Lending Essentials

The federal fair lending landscape has changed significantly—and financial institutions need to understand what those changes actually mean for their fair lending compliance programs. Changes in federal enforcement priorities, regulatory interpretation, and supervisory expectations have created questions for compliance professionals. Has fair lending enforcement really changed? What happened to disparate-impact risk? What remains enforceable under ECOA and the Fair Housing Act? How should institutions approach redlining, HMDA data, marketing, underwriting discretion, and fair lending testing in today's environment? This 90-minute live webinar cuts through the uncertainty and focuses on what compliance professionals need to know now. Rather than simply reviewing the fundamentals of fair lending, this program examines the current regulatory landscape, the risks that remain, and the practical steps institutions should take to ensure their fair lending programs remain effective, defensible, and aligned with current requirements.

Review the significant changes in federal fair lending policy and enforcement priorities and what they mean for financial institutions.

  • Separate Regulatory Change From Compliance Risk
Understand which fair lending requirements have changed, which remain in place, and why a change in federal enforcement priorities does not eliminate fair lending risk.

  • Take a Fresh Look at Disparate Impact
Examine the current regulatory treatment of disparate-impact theory and what compliance professionals should consider when evaluating policies, procedures, products, and lending practices.

  • Understand Where Intentional Discrimination Risk Remains
Review disparate treatment and other forms of prohibited discrimination and consider how lending decisions, exceptions, pricing, steering, and discretion can create risk.

  • Reevaluate Your Fair Lending Program
Consider whether your current risk assessment, policies, testing, monitoring, training, and governance processes still make sense in today's regulatory environment—or whether they need to be adjusted.

  • Connect HMDA and Fair Lending
Explore how HMDA data can help identify lending patterns and potential risk, while recognizing the limitations of using HMDA data as a standalone fair lending analysis.

  • Understand Redlining Risk
Review the continued importance of geographic lending patterns, assessment areas, marketing, branch locations, outreach, and community access when evaluating potential redlining concerns.

  • Look Beyond Federal Enforcement
Consider fair lending risk arising from state regulators, state attorneys general, litigation, community organizations, and other external stakeholders.

  • Consider the Impact of Marketing and Technology
Explore how advertising, digital marketing, automated decision-making, and other technology-driven lending processes can create fair lending concerns even when traditional underwriting processes have not changed.
